Well certainly they *can* do that but that's not to say they would. If they were doing something sneaky and underhanded like that it would have already been exposed and their corporate and government customers would scream bloody murder until MS released a patch to eliminate the behavior. Some might even press charges against them. With more and more businesses and whole goverments turning to open source solutions as time progresses MS simply cannot afford to be playing games like that.

As far as checking available disk space, that is probably correct but I see no need whatsoever to send it across the network.
